A SUPREMA CORTE DOS ESTADOS UNIDOS E A SUBTRAÇÃO INTERNACIONAL DE CRIANÇAS: O “DIREITO CONVENCIONAL DE GUARDA”
Resumo
A Convenção da Haia sobre os Aspectos Civis do Sequestro Internacional de Crianças (Convenção da Haia de 1980) visa desencorajar e reprimir a transferência e/ou retenção de uma criança em país diverso daquele em que possui residência habitual. Na configuração da subtração internacional, é necessário, dentre outros aspectos, averiguar a titularidade do “direito de guarda”, que deverá ser manejado em conformidade com o conteúdo e alcance que lhe é conferido pelo tratado. No entanto, desde o início da aplicação da convenção observa-se que a teoria e a jurisprudência oscilam na interpretação deste direito. Após contextualizar historicamente a proteção internacional da criança e as discussões teóricas e práticas sobre o “direito convencional de guarda” – nomenclatura proposta por esta subscritora – será pormenorizado e discutido o Caso Abbott v. Abbott, decidido em 2010 pela Suprema Corte dos EUA, onde tal direito foi definido. Por fim, discutir-se-á o impacto deste julgamento na consolidação deste conceito perante a comunidade internacional e em sua hermenêutica pelos aplicadores domésticos.
