ANOTAÇÕES SOBRE A RESPONSABILIDADE CIVIL NO DIREITO AMERICANO INTENTIONAL TORTS
Resumo
A responsabilidade civil nos Estados Unidos há muito se encontra sedimentada e desenvolvida na sua jurisprudência, bem como em diversas normas erigidas por cada um dos estados federados. Dada a amplitude do tema, o enfoque do artigo será o intentional tort, i.e, quando o agente atua lesivamente em detrimento de outrem ou de coisa alheia. Abordar-se-ão os tipos do battery, assault, false imprisonment, false arrest, trespass e conversion e as excludentes de responsabilidades mais aceitas e utilizadas naquele país.
